Terms of Service

By accessing or using the Penetrify platform (the 'Service'), you agree to be bound by these Terms of Service ('Terms'). If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms. If you do not agree to these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you and Algofy, s.r.o. (ID No. 19499773), with its registered office at Nové sady 988/2, 602 00 Brno, Czech Republic ('Penetrify', 'we', 'us', or 'our').

Penetrify provides an AI-powered automated penetration testing platform for web applications. The Service analyses target systems for security vulnerabilities, generates detailed vulnerability reports, and provides remediation guidance. The Service is intended for authorised security testing only.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time. We will provide reasonable notice of material changes that may affect your use of the Service.

To access the Service, you must register for an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must notify us immediately at legal@penetrify.cloud if you suspect any unauthorised use of your account. We are not liable for any loss or damage arising from your failure to maintain the security of your account.

You may only use the Service to conduct security testing on systems and applications for which you have explicit written authorisation from the system owner. Using Penetrify to test systems without such authorisation is strictly prohibited and may constitute a criminal offence under applicable law.

You must not use the Service to: conduct denial-of-service attacks; access, extract, or exfiltrate data beyond what is necessary for security testing; test systems belonging to third parties without authorisation; or engage in any activity that violates applicable law or the rights of others.

We may suspend or terminate your account immediately if we determine that you are using the Service in violation of this Acceptable Use Policy or applicable law.

The Service is available under the following subscription plans: Starter ($50/month, 1 penetration test per month); Professional ($600/month, 20 penetration tests per month); Enterprise ($2,500/month, 100 penetration tests per month). Pay-as-you-go tests are also available from $36 per test. All prices are in USD and exclusive of applicable taxes.

Subscriptions are billed monthly in advance. Payment is due at the beginning of each billing cycle. If payment fails, we may suspend your access to the Service until payment is received. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

We reserve the right to change our pricing with at least 30 days' notice. Continued use of the Service after a price change takes effect constitutes acceptance of the new pricing.

The Service, including all software, algorithms, reports generated by the Service, and related documentation, is owned by Algofy, s.r.o. and protected by intellectual property laws. These Terms do not grant you any right, title, or interest in the Service beyond the limited licence to use the Service in accordance with these Terms.

You retain all rights to the target systems and data you submit for security testing. You grant us a limited licence to process your data solely for the purpose of providing the Service.

Our collection and use of personal data in connection with the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described in the Privacy Policy.

Where applicable, we will enter into a Data Processing Agreement (DPA) with you to govern the processing of personal data on your behalf. Please contact legal@penetrify.cloud to request a DPA.

The Service is provided 'as is' and 'as available' without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that it will identify all security vulnerabilities in your systems. Security testing is inherently limited and should be used as one component of a comprehensive security programme.

To the maximum extent permitted by applicable law, Algofy, s.r.o. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the Service.

Our total aggregate liability to you for any claims arising out of these Terms or your use of the Service shall not exceed the amounts paid by you to us in the 12 months preceding the event giving rise to the claim.

You agree to indemnify, defend, and hold harmless Algofy, s.r.o. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: your use of the Service in violation of these Terms; your breach of any representation or warranty; or your violation of any applicable law or third-party rights.

You may terminate your account at any time by contacting us at legal@penetrify.cloud. We may terminate or suspend your account immediately, without prior notice, if you breach these Terms, if required by law, or if we determine that your use of the Service presents a risk to other users or to the Service itself.

Upon termination, your right to use the Service will cease immediately. We will retain your data for the periods specified in our Privacy Policy, after which it will be deleted or anonymised.

These Terms are governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

In the event of any dispute arising out of or relating to these Terms or the Service, the parties shall first attempt to resolve the dispute through good-faith negotiation. If the dispute cannot be resolved within 30 days, either party may submit it to binding arbitration or to the competent courts of the Czech Republic.

We may update these Terms from time to time. When we make material changes, we will notify you by email or by a prominent notice within the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date of the changes constitutes your acceptance of the updated Terms.
